Kallar Syedan; Shah Khaki Murder Case: Muhammad Ashfaq Sentenced to Death

کلر سیداں (نمائندہ پوٹھوار ڈاٹ کوم — اکرام الحق قریشی | 27، نومبر، 2025ء) — ایڈیشنل ڈسٹرکٹ اینڈ سیشن جج کلر سیداں جہانگیر علی گوندل نے گاؤں شاہ خاکی کے قتل کیس کا فیصلہ سناتے ہوئے جرم ثابت ہونے پر مجرم محمد اشفاق کو سزائے موت کا حکم سنا دیا۔ عدالت نے اپنے فیصلے میں کہا کہ مجرم مقتول کے ورثا کو 5 لاکھ روپے بطور معاوضہ ادا کرے، بصورتِ دیگر اسے چھ ماہ سادہ قید کا سامنا کرنا ہوگا۔ عدالت کے حکم کے مطابق یہ رقم اراضی ریونیو کے واجبات کی طرح وصول کی جائے گی۔عدالتی فیصلے میں کہا گیا ہے کہ مجرم کی سزائے موت پر عمل درآمد لاہور ہائی کورٹ کی توثیق سے مشروط ہے،جس کے لیے ریفرنس بھجوا دیا گیا ہے۔مزید برآں عدالت نے محمد اشفاق کو ایک اور الزام میں 10 سال قیدِ با مشقت اور 2 لاکھ روپے جرمانہ کی سزا بھی سنائی۔ جرمانہ ادا نہ کرنے کی صورت میں اسے مزید چھ ماہ قید کاٹنی پڑے گی۔زخمی خاتون مسرت شاہین کی عزت مجروح کرنے کے جرم میں بھی ملزم کو ایک سال قیدِ با مشقت اور 50 ہزار روپے جرمانہ کی سزا سنائی گئی ہے اور جرمانہ ادا نہ کرنے پر اسے دو ماہ سادہ قید کی سزا بھگتنا ہو گی اس کے علاوہ عدالت نے مجرم کو ہدایت کی کہ وہ مسرت شاہین کو 20 ہزار روپے بھی ادا کرے۔عدالت نے قرار دیا کہ ملزم کو دی گئی تمام سزائیں بیک وقت شروع ہونگی جبکہ اسے سیکشن 382-B کے تحت سزاؤں میں رعایت بھی دی گئی ہے۔یاد رہے کہ 21 جولائی 2023 کو مجرم محمد اشفاق نے فرزانہ نامی خاتون کو گولی مار کر قتل جبکہ مسرت شاہین کو زخمی کر دیا تھا جس پر مقتولہ کے خاوند اسرار حسین سکنہ شاہ خاکی کی مدعیت میں محمد اشفاق کیخلاف تھانہ کلر سیداںمیں قتل کا مقدمہ درج ہوا تھاجس کا معزز عدالت نے گزشتہ روز فیصلہ سنا دیا۔مدعی کی جانب سے پنجاب بار کونسل کے ممبر قیصر مشتاق ایڈووکیٹ نے کیس کی پیروی کی۔

Additional District and Sessions Judge Kallar Syedan, Jahangir Ali Gondal, has announced the verdict in the Shah Khaki village murder case, handing down a death sentence to the convict, Muhammad Ashfaq, after the charges against him were proven.

According to the court’s decision, the convict must pay Rs. 500,000 as compensation to the legal heirs of the deceased. If he fails to pay the amount, he will undergo six months of simple imprisonment. The judgment further states that the compensation will be recovered in the same manner as land revenue dues.

The court also noted that the implementation of the death penalty is subject to confirmation by the Lahore High Court, for which a reference has already been dispatched.

In a separate charge, the court awarded Muhammad Ashfaq 10 years of rigorous imprisonment along with a fine of Rs. 200,000. Failure to pay the fine will result in an additional six months’ imprisonment.

For injuring and violating the dignity of the injured woman, Musarrat Shaheen, the convict was handed one year of rigorous imprisonment and a fine of Rs. 50,000. In case of non-payment, he will have to serve two months of simple imprisonment. Additionally, the court directed him to pay Rs. 20,000 to Musarrat Shaheen.

The court ruled that all sentences will run concurrently, and the convict has been granted the benefit of Section 382-B of the Criminal Procedure Code.

It is worth mentioning that on July 21, 2023, Muhammad Ashfaq shot and killed a woman named Farzana and injured Musarrat Shaheen. Following the incident, the deceased woman’s husband, Israr Hussain, a resident of Shah Khaki, registered a murder case against Ashfaq at the Kallar Syedan Police Station. The honourable court delivered its verdict yesterday.

The case was pursued on behalf of the complainant by Advocate Qaiser Mushtaq, a member of the Punjab Bar Council.
