Rawat: Judicial Commission Approves Transfer of Three High Court Judges

روات (پوٹھوار ڈاٹ کام — اکرام الحق قریشی | 29 اپریل 2026)—اسلام آباد میں چیف جسٹس پاکستان جسٹس یحییٰ آفریدی کی زیر صدارت جوڈیشل کمیشن آف پاکستان کا اجلاس منعقد ہوا جس میں ہائیکورٹ کے متعدد ججوں کے تبادلوں کی منظوری دے دی گئی۔

اجلاس میں ججز کے تبادلوں سے متعلق امور پر غور کیا گیا، جس کے دوران جسٹس محسن اختر کیانی کے لاہور ہائیکورٹ تبادلے کی منظوری دی گئی۔ یہ فیصلہ اکثریتی رائے سے کیا گیا اور 9 ارکان نے اس کے حق میں ووٹ دیا۔

جوڈیشل کمیشن نے جسٹس ثمن رفعت امتیاز کے سندھ ہائیکورٹ تبادلے کی بھی منظوری دے دی، جو اکثریتی رائے سے منظور ہوا۔

ذرائع کے مطابق جسٹس بابر ستار کا اسلام آباد ہائیکورٹ سے پشاور ہائیکورٹ تبادلہ کر دیا گیا، تاہم اس کے خلاف تین ووٹ سامنے آئے۔

اس سے قبل جسٹس بابر ستار نے چیف جسٹس کو ایک خط لکھا تھا جس میں مؤقف اختیار کیا گیا کہ آئین کے آرٹیکل 200 کے تحت کسی بھی جج کے تبادلے سے قبل اسے ذاتی طور پر سنا جانا چاہیے۔ انہوں نے کمیشن سے درخواست کی تھی کہ فیصلہ کرنے سے پہلے انہیں اپنا مؤقف پیش کرنے کا موقع دیا جائے۔

دوسری جانب جسٹس سرفراز ڈوگر نے جسٹس ارباب طاہر اور جسٹس خادم سومرو کے تبادلوں کی سفارش واپس لے لی، جس کے بعد ان کے تبادلوں کا معاملہ مؤخر کر دیا گیا۔

Rawat (Pothwar.com — Ikram-ul-Haq Qureshi | 29 April 2026):  In Islamabad, a meeting of the Judicial Commission of Pakistan was held under the chairmanship of Chief Justice Justice Yahya Afridi, where the transfer of several High Court judges was approved.

The commission reviewed matters related to judicial transfers, including the approval of Justice Mohsin Akhtar Kayani to the Lahore High Court. The decision was made by a majority vote, with nine members supporting the move.

The commission also approved the transfer of Justice Saman Rafat Imtiaz to the Sindh High Court, again through a majority decision.

According to sources, Justice Babar Sattar of the Islamabad High Court has been transferred to the Peshawar High Court, though three members voted against his transfer.

Earlier, Justice Babar Sattar had written a letter to the Chief Justice, stating that under Article 200 of the Constitution, a judge should be heard personally before any transfer decision. He requested the commission to allow him to present his position prior to a final decision.

Meanwhile, the commission deferred the transfer of other judges after Justice Sarfraz Dogar withdrew recommendations regarding Justice Arbab Tahir and Justice Khadim Soomro.
