کروٹ ہائیڈرو پاور پراجیکٹ پرائیویٹ کمپنی کو عدالت نے متاثرین اراضی کی قیمت 70ہزار فی کنال سے بڑھا کر 5لاکھ روپے فی کنال ادا کرنے کا فیصلہ جاری کر دیا۔ مقدمہ کی پیروی ممتاز سنیئر قانون دان راجہ ایم ستار اللہ ایڈووکیٹ سپریم کورٹ نے کی۔ پانچ سال عدالت میں زیر سماعت رہنے کے بعد از شہادت احکامات چیف جسٹس پنجاب اور سیشن جج راولپنڈی کی جانب سے پرانے مقدمات کے فیصلے کو جلد از جلد مکمل کیا جائے۔ جس پر 2016کے مقدمہ ہذا کے تحت سنیئر سول جج ملک شاہد اعوان نے فیصلہ سائلیں چوہدری ابرابر حسین،اعجا ز احمد راجہ اور راجہ ایم ستار اللہ کے حق میں جاری کر دیا۔ تفصیل کے مطابق ممتاز سنیئر قانون دان راجہ ایم ستار اللہ ایڈووکیٹ کی جانب سے سائلین و متاثرین نے عدالت میں مقدمہ دائر کیا۔جس کے تحت پرائیویٹ کروٹ پاور کمپنی نے ڈیم کی تعمیر کے لیئے اور بجلی گھر بنانے کے لیئے موضع بیور کروٹ اور گوہڑہ سے مختلف اشخاص کی آراضی ایکوائر کی تھی۔ جن میں چوہدری ابرار حسین، اعجاز احمد راجہ، راجہ ایم ستار اللہ کی آراضیات بلترتیب 30,34اور 60کنال ایکوائر کی گئی تھی۔ جبکہ نہ تو درختوں کی قیمت اور نہ ہی معقول معاوضہ دیا گیا۔ جس پر ہر سہ مالکان نے بذریعہ راجہ محمد ستار اللہ ایڈووکیٹ سپریم کورٹ ریفرنس کلیکٹرتحصیل کہوٹہ کیے پاس دائر کیا۔جنہوں نے برائے ریفرنس جناب سنیئر سول جج راولپنڈی کو ریفرنس بھیجا۔ جس میں آراضی موضع گوہڑہ کی قیمت 40ہزار فی کنال جبکہ موضع بیور کی 70ہزار فی کنال رکھی گئی تھی۔ موقف سائلان کے مطابق لینڈ ایکویزیشن رولز کے مطابق یک سالہ اوسط نوٹیفکیشن سے قبل ملحقہ آراضیات کو ملحو ظ نہ رکھا گیا جبکہ ملحقہ آزاد کشمیرسے ایکوائر شدہ آراضی جوکہ کہوٹہ سے کم تر ہے۔ ا س کی قیمت 6لاکھ روپے فی کنا ل دی گئی۔ بعدا زشہادت جناب احکامات چیف جسٹس پنجاب اور سیشن جج راولپنڈی نے پرانے مقدمات کے فیصلے کو 31-03-2021تک زیادہ سے زیادہ ختم کرنے کے احکامات صادر کیئے گئے۔ جس کی وجہ سے مقدمہ ہذا 2016کا ہونے کی وجہ سے جناب سنیئر سول جج شاہد اعوان صاحب نے جہان دیگر مقدمات ریفرنس بے شمار کا فیصلہ کیا وہاں مقدمہ ہذا کا بھی فیصلہ مورخہ 31-03-2021کو کردیا۔ اور اس طرح ایوارڈ کی رقم مبلغ 40ہزار اور 70ہزار فی کنال سے بڑھا کر 5لاکھ روپے فی کنال ڈگری فرمایا جبکہ اس کے ساتھ ساتھ 15فیصد جا برانہ اور 8فیصد کمپاؤنڈ اٹرسٹ بھی ڈگری فرمایا۔ ریفرنس مذکورہ میں سائلان کو کی طرف سے پیروی راجہ محمد ستار اللہ ایڈووکیٹ سپریم کورٹ اور واجد محمو د ستی ایڈووکیٹ ہائی کورٹ نے کی۔
Kahuta; The court decided to increase the price of the affected lands from Rs 70,000 per kanal to Rs 500,000 per kanal to Karot Hydropower Project Private Company.
The case was pursued by eminent senior jurist Raja M. Sattarullah Advocate Supreme Court. After five years of hearing in the court, the verdicts of old cases by the Chief Justice of Punjab and Sessions Judge Rawalpindi should be completed as soon as possible.
Under the 2016 case, Senior Civil Judge Malik Shahid Awan passed the verdict in favor of Chaudhry Abrar Hussain, Ejaz Ahmad Raja and Raja M Sattarullah.
According to the details, the plaintiffs and the victims filed a case in the court on behalf of the eminent senior lawyer Raja M. Sattarullah Advocate.
The lands of different persons were acquired. In which lands of Chaudhry Abrar Hussain, Ejaz Ahmad Raja, Raja M. Sattarullah were acquired 30, 34 and 60 kanals respectively. Neither the price of the trees nor reasonable compensation was given. Each of the three owners filed the petition through Raja Muhammad Sattarullah, Advocate, Supreme Court Reference Collector, Tehsil Kahuta, who referred the matter to Mr. Senior Civil Judge, Rawalpindi for reference.
In which the price of land Mouza Gohra was fixed at Rs 40,000 per Kanal while that of Mouza Bior was fixed at Rs 70,000 per canal. According to the land acquisition rules, the adjoining lands were not taken into consideration before the one-year average notification, while the lands acquired from the adjoining Azad Kashmir, which is less than Kahuta, were not taken into account.
It was priced at Rs. 6 lakh per Kanal. Following the martyrdom of Mr. Justice, orders were issued by the Chief Justice of Punjab and Sessions Judge Rawalpindi to terminate the verdicts of the old cases till 31-03-2021. Due to which this case is from 2016, Mr. Senior Civil Judge Shahid Awan Sahib decided on a number of other cases with reference to this case and also decided this case on 31-03-2021. Thus, the amount of the award was increased from Rs. 40,000 and Rs. 70,000 per canal to Rs. 500,000 per canal, while at the same time, 15 per cent Ja Barana and 8 per cent compound interest degrees were also given.
The case was followed by Raja Muhammad Sattarullah Advocate Supreme Court and Wajid Mahmood Satti Advocate High Court.
