London (Pothwar.com – Mohammad Naseer Raja, November 4, 2026): British Home Secretary Shabana Mahmood has announced major changes to the UK’s immigration settlement rules, introducing new requirements for migrants seeking Indefinite Leave to Remain (ILR), also known as permanent residency or settlement.
Under the proposed changes, social care workers earning £25,000 a year will be eligible to apply for permanent settlement after five years of residence in the UK. Previously, care workers were required to live in the country for 15 years before qualifying for settlement.
Mahmood said that individuals who arrived in the UK before May 2025 would be eligible for this concession. Meanwhile, the qualifying period for other lower-paid workers will increase to 10 years.
Workers earning more than £50,000 annually, along with those employed in the health and education sectors, will remain eligible to apply for settlement after five years.
The Home Secretary also warned that applicants with criminal records, those unable to speak English, and individuals who fail to repay debts or meet their National Insurance obligations could be refused permanent residency.
New Settlement Requirements for Asylum Seekers and Illegal Migrants
According to the proposals, people who enter the UK through legal routes and subsequently claim asylum will be able to apply for settlement after five years.
However, individuals who enter the country illegally will have to wait 20 years before becoming eligible to apply for permanent residency.
The same requirements will apply to those studying or working in the UK. Individuals who are neither working nor studying could face an additional 10-year waiting period, taking the total qualifying period to 30 years.
Mahmood stressed that the right to settle in Britain would no longer be automatic and that migrants would have to earn the right through their contributions and conduct.
What Does Indefinite Leave to Remain Mean?
Indefinite Leave to Remain (ILR), commonly known as settlement, allows an individual to live in the UK permanently without time restrictions.
People granted ILR can work and study in the country without requiring further immigration permission. Subject to eligibility, they may also apply for certain benefits and eventually seek British citizenship.
Media reports suggest that the Home Secretary has expressed concerns about the growing number of people becoming eligible for permanent settlement following the significant rise in net migration under the previous government.
Government Faces Criticism Over Proposed Changes
Mahmood has reportedly faced criticism within the Labour government over the possibility of applying the new rules to migrants who are already living in the UK.
Housing Secretary Angela Rayner and several Labour MPs have reportedly criticised the proposals, describing aspects of the suggested approach as unfair to people who came to Britain under previously established immigration rules.
According to the Home Office, the UK’s population increased by 2.6 million between 2021 and 2024.
Media reports, citing Home Office projections, suggest that a further 1.6 million people could settle in the UK between 2026 and 2030.
More than 200,000 people submitted responses to the government’s consultation on the proposed immigration reforms.
Reducing the Financial Burden on the Public
Mahmood has argued that the purpose of reforming the immigration system is to reduce the financial burden on British taxpayers and ensure that migrants make a positive contribution to the country.
Between 2022 and 2024, approximately 616,000 people came to the UK to fill between 6,000 and 40,000 job vacancies, according to the figures cited in media reports.
She claimed that more than half of those arrivals were dependants of people who had originally come to Britain for employment.
Mahmood is now seeking to reshape the same immigration system under which her own parents came to Britain from Kashmir.
Prime Minister Says Net Migration Has Fallen Significantly
Meanwhile, British Prime Minister Andy Burnham said it was difficult to determine whether the level of legal migration into the UK was too high or too low.
He acknowledged that legal migration had fallen considerably, with net migration standing at 171,000 in 2025, approximately half the figure recorded in the previous year.
The proposed reforms represent a significant shift in Britain’s immigration settlement policy and could have major implications for hundreds of thousands of migrants currently living and working in the country.
