Rawat (Pothwar.com \u2014 Ikram Ul Haq Qureshi | May 13, 2026):<\/strong> The Federal Constitutional Court has dismissed an appeal filed by a private bank in an online banking fraud case and upheld previous orders directing the bank to return the stolen money to the affected citizen.<\/h4>\n

A two-member bench headed by Justice Aamir Farooq<\/span><\/span> heard the case related to online banking fraud. During the hearing, Justice Aamir Farooq remarked that hackers are often already present within banking systems, stating that customer data reaches hackers even before bank accounts are officially opened.<\/h4>\n

Justice Aamir Farooq also shared his personal experience, saying that he once received a fraudulent phone call regarding his own account at a private bank. He said the caller asked him to share a one-time password (OTP), warning that his account would otherwise be blocked. The judge said he refused because the account had remained inactive for several years.<\/h4>\n

The court raised serious concerns over banking security and emphasised that banks are responsible for ensuring the safety of their systems so that citizens\u2019 funds remain protected.<\/h4>\n

The counsel for the private bank argued that the transaction had been carried out through the citizen\u2019s own banking application, while the citizen maintained that his mobile number had been stolen.<\/h4>\n

Justice Aamir Farooq observed that the Banking Mohtasib, the President of Pakistan, and the High Court had all previously ruled against the bank.<\/h4>\n

The Federal Constitutional Court subsequently rejected the bank\u2019s appeal and ordered the bank to refund the amount to the citizen.<\/h4>\n
